Terms of Service

1. AGREEMENT TO TERMS
By accessing this website or booking any service from Market Your Products, you agree to these Terms of Service. If you do not agree, do not use this site or purchase from us. These terms apply to all clients, regardless of how they found us or how they booked.

2. OUR SERVICES
We offer Revenue Diagnostic ($300), Fresh Build — Path 1 ($5,000), ESP Fix — Path 2 ($3,500), and Monthly Operations ($4,000/month). (Refer to website for full service descriptions).

3. WHAT WE GUARANTEE — AND WHAT WE DON’T
We don’t guarantee specific sales, revenue amounts, or email delivery rates.
Our performance guarantee: If you complete a full 90-day engagement and do not receive at least 3 qualified replies, we manage the following month at no charge.
A “qualified reply” is defined as a response from a prospect or past customer that includes a request for a quote, pricing question, call request, or intent to purchase.
Market Your Products reserves the final right to determine whether a response meets the ‘qualified reply’ criteria based on the intent shown in the message.

4. WHAT YOU MUST PROVIDE
You are responsible for accurate lists, permission to email, compliance with CAN-SPAM/GDPR/CASL, and timely approvals. If you provide a list that results in legal action or blacklisting, you are fully liable.

5. ESP ACCOUNTS AND OWNERSHIP
You own your ESP account and contact lists. You are responsible for the monthly ESP subscription cost.

6. PAYMENT
Fees are due at booking or project start. Monthly Operations is billed on the 1st. Late payments (14+ days) may result in a pause of work and 1.5% late fee.

7. REVISION LIMITS
Includes up to 2 rounds on copy and 1 round on segmentation/dashboard. Additional revisions are $150/hr.

8. CANCELLATION AND REFUNDS
Diagnostic: No cash refunds. Project: Prorated based on work completed. Monthly Operations: 14 days notice required.

9. YOUR CUSTOMER LIST
You own your list. You guarantee you have permission to email every contact.

10. OUR WORK PRODUCT
Upon full payment, we grant you a perpetual, non-exclusive, non-transferable license to use the specific email copy and templates created for your business. You do not own our frameworks, methods, or systems (e.g., Power of Three Method), which remain our sole intellectual property.

11. CONFIDENTIALITY
We keep your data confidential. We may reference general results in marketing. You agree to keep our methods and frameworks confidential.

12. LIMITATION OF LIABILITY
We are not liable for lost sales, delivery failures, or damage to sender reputation. Total liability is capped at the amount paid in the 90 days preceding a claim.

13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Market Your Products and its team from any claims, damages, liabilities, or costs (including legal fees) arising from your breach of these terms, your violation of any laws (including CAN-SPAM or GDPR), or the quality and provenance of the contact lists you provide.

14. FORCE MAJEURE
We are not liable for any delay or failure to perform our obligations if such delay is caused by events outside our reasonable control, including internet outages, third-party platform failures, natural disasters, or changes in law/regulation.

15. TERMINATION BY US
We may terminate immediately for non-payment, breach of terms, illegal requests, or abusive behavior.

16. WEBSITE USE
Do not scrape, hack, or misrepresent affiliation.

17. THIRD-PARTY SERVICES
We use Stripe, ActiveCampaign, and Google Analytics. We are not responsible for their outages or policy changes.

18. CHANGES TO THESE TERMS
We may update terms at any time. Material changes will be notified via email.

19. DISPUTE RESOLUTION
Disputes will be resolved via binding arbitration in Los Angeles County, California. Class action claims are waived.

20. GOVERNING LAW
Laws of the State of California, USA.

21. ENTIRE AGREEMENT
These terms and our Privacy Policy constitute the entire agreement.
